§ 22-5. Soil and water approval.
Before grading is started, the entire right-of-way area shall be first cleared of all stumps, roots, brush and other objectionable material and all trees not intended for preservation. The developer shall be responsible to obtain approval from the local soil and water conservation district, with the following areas from the E&S Regulations section 1.8 specifically addressed:
(1)
If individual lots or sections in a residential development are being developed by different property owners, all land-disturbing activities related to the building construction shall be covered by an erosion and sediment control plan or an "agreement in lieu of a plan" signed by the property owner.
(2)
Land-disturbing activity of less than 10,000 square feet on individual lots in a residential development shall not be considered exempt from the provisions of the act and these regulations.
(3)
The construction of permanent roads or driveways that disturb in excess of 10,000 square feet and that serve more than one single-family residence separately built is not exempt.
